MEDIATION - PROCEDURES FOR MEETING TO ENCOURAGE MEDIATION (IDEA-97)
Whenever a dispute arises involving a proposal or refusal by the school district to initiate or
change the identification, evaluation, or educational placement of a child with disabilities, or the
provision of a free, appropriate public education to the child, and the school district believes that the
dispute may be resolved through mediation, the school district shall suggest use of the mediation
process to the parents.
If the parents choose not to use the mediation process, the school district will determine a
time and location convenient to the parents and require the parents to meet at that time and location
with a person selected by the district who is under contract with ___________________________
or __________________________ and is a disinterested party. At this meeting, the person selected
shall explain the benefits of the mediation process to the parents and encourage its use.
